U.S. agent can be sued over Mexican boy's shooting death across border
The dissenting judge from the 9th U.S. Circuit Court of Appeals' 2-1 decision accused the majority of ignoring legal precedent and said the Supreme Court may need to weigh in. Tuesday's decision allows Araceli Rodriguez to sue the agent Lonnie Swartz over the Oct. 10, 2012 shooting of 16-year-old Jose Antonio Elena Rodriguez. Swartz said he acted in self-defense in response to a group of rock throwers, while Rodriguez said her son was walking peacefully.
