Attorneys ask for dismissal of new Waco indictment
WACO, Texas (AP) — Citing procedural rules, Houston-based attorneys representing a defendant in a deadly Waco gunfight have asked a judge to dismiss a new indictment against their client.
In a motion filed Monday, Marcus Pilkington's attorneys say the state "ignored" procedures that would allow for the original indictment against their client to be amended.
The 2015 gunfire outside a Twin Peaks restaurant in Waco left nine bikers dead and dozens injured.
In the motion, the attorneys argued the state issued a new indictment last month with the same cause number as the original indictment against Pilkington in the case, but charged their client with a different offense.
