Human rights activist, Comrade Culture Iyamu, on Wednesday escaped been remanded in prison custody by the whiskers, over alleged conduct likely to cause breach of public peace.
Iyamu who was docked by the Edo state police commissioner at an Oredo Magistrate court 4, sitting in Benin was charged for blocking the entrance to Governor Adams Oshiomhole’s office with his car following a face-off with security operatives at the Government House, Benin City.
The accused pleaded not guilty when the charge was read to him.
Counsel to the accused, Abraham Oviawe, thereafter made an oral application for his bail, but was vehemently opposed by the prosecution team led by Inspector Iredia.
The prosecution hinged its argument on ground of “character evidence” against the accused whose arrest was ordered by Government House Chief Security Officer (CSO), on Tuesday.
Responding, the defence counsel argued that opposing the bail application on ground of “character evidence” was like putting the cart before the horse and offending the rights of the accused person to fair hearing.
The presiding magistrate, Mrs. M. O. Adebanjo granted the accused bail in the sum of N300, 000 and a surety in the like sum.
Adebanjo who ruled that the surety must be a property owner and resident within the jurisdiction of the court adjourned to 17th March 2016 for hearing.
